Terms of Service

The deal between you and Holofile, kept as short and plain as we could.

These terms

Holofile is operated by Holofile LLC, based in Florida, USA (“Holofile”, “we”, “us”). These terms cover your use of Holofile’s online services: accounts, Cloud sync, Holo10, support and this website (together, the “service”). By using the service, you agree to them.

The Holofile iPhone app is licensed to you under Apple’s Licensed Application End User License Agreement (the standard EULA). These terms govern the Holofile service on top of it. Our privacy policy explains how we handle your data.

Anyone can use the Holofile app on their phone. To create an account, buy Holo10 or write to support, you need to be at least 13, or older if your country requires it. If you’re under 18, a parent or guardian should read and agree to these terms with you.

The Holofile service

Holofile helps you track Pokémon TCG cards and sealed product: what you paid, what it’s worth and what you pulled. Your collection is stored on your iPhone and most of Holofile works without an account. Some features use our servers: the card catalog and prices, spreadsheet matching, accounts, Cloud sync and support.

We keep improving Holofile, so features may change, and some may be added or retired. We try to keep the service running smoothly, but it may sometimes be unavailable, for example during maintenance or outages.

Your account

An account is optional; Cloud sync needs one. You sign in with a code we email you, so keep your email account secure. You’re responsible for what happens in your Holofile account, and your account is for you alone. Tell us at hello@holofile.app if you think someone else has used it.

You can delete your account at any time in the app: Settings → Account → Delete account.

Holo10

Holo10 is Holofile’s paid tier. What it includes is described in the app before you buy. You can buy it in the app as a monthly or yearly subscription, or as a one-time Lifetime purchase.

  • Payment: Apple processes every purchase through your Apple Account, under the App Store’s terms. Payment is charged to your Apple Account when you confirm the purchase.
  • Auto-renewal: subscriptions renew automatically at the end of each period, at the then-current price, unless you cancel at least 24 hours before the period ends. Apple charges the renewal within the 24 hours before the period ends.
  • Free trial: the yearly plan may include a 7-day free trial for Apple Accounts that haven’t had one. Unless you cancel at least 24 hours before the trial ends, the yearly subscription starts and you’re charged. If you buy another plan during a trial, the rest of the trial ends.
  • Cancelling: manage or cancel in your iPhone’s Settings → your name → Subscriptions, or in Holofile under Settings → Holo10 → Manage subscription. Cancelling stops the next renewal; Holo10 keeps working until the end of the period you’ve paid for. Deleting the app or your account doesn’t cancel a subscription.
  • Refunds: Apple handles refunds under its policies. Request one at reportaproblem.apple.com; we can’t issue App Store refunds ourselves.
  • Lifetime: a one-time, non-consumable purchase. It unlocks Holo10 on your Apple Account with no renewals, for as long as we offer Holofile and Holo10, and you can restore it on your other devices with Restore purchases.
  • Price changes: we may change prices. Apple tells subscribers about a price increase before it applies and, where required, asks you to agree first. You can cancel before a new price takes effect.
  • Cloud sync needs an account and an active Holo10. If Holo10 ends, sync pauses and your collection stays on your phone.

Prices and card matches

Prices in Holofile are estimates from third-party market data. They can be delayed, incomplete or wrong, and prices for some conditions are estimated from the Near Mint price. They are not offers to buy or sell, not appraisals, and not financial, investment or tax advice. Don’t rely on them alone when you buy, sell, insure or value anything.

Scanning and spreadsheet matching can pick the wrong card or printing. Check what Holofile adds, especially for valuable cards.

Your content

Your collection data, notes, photos and messages to us are yours. When you turn on Cloud sync or write to support, you give us permission to store, copy and transmit that content only to run the service for you, such as syncing it between your devices and backing up your photos. This permission ends when you delete the content or your account, apart from copies we briefly keep as described in the privacy policy.

Only upload photos you have the right to use, and don’t upload anything illegal or anyone else’s private information.

Acceptable use

Please don’t:

  • use the service to break the law or someone else’s rights;
  • copy, scrape or resell Holofile’s catalog, prices or images, or access our servers other than through the app and this website;
  • get around rate limits, bot checks or Holo10 checks, or probe, overload or interfere with our servers;
  • reverse engineer the service, except where the law allows it despite this term;
  • send spam or abuse through the support form; or
  • use someone else’s account, or pretend to be someone else.

Our app and other people’s trademarks

The Holofile name, logo, app, website and service belong to us. You may use them only as these terms and the standard EULA allow.

Holofile is an independent app and is not affiliated with, endorsed by or sponsored by Nintendo, The Pokémon Company, Creatures or GAME FREAK. Pokémon and card names, images and logos are trademarks of their respective owners. Prices are estimates from third-party market data and are not offers to buy or sell.

Card names, images and set details appear in Holofile only to identify the cards you own. We don’t claim any rights in them.

Other services

Holofile relies on other companies, including Apple for the App Store and payments, RevenueCat for checking purchases and Cloudflare for hosting. Their own terms apply to your use of their services, and we aren’t responsible for them.

Ending things

You can stop using Holofile at any time and delete your account in the app. We may suspend or close an account that breaks these terms, puts others at risk or exposes us to legal trouble, and we’ll tell you why unless the law or safety stops us. If we ever shut the service down, we’ll give you reasonable notice first. The collection on your phone stays yours either way.

The parts of these terms that by their nature should continue, such as disclaimers, limits of liability and governing law, survive when they end.

Disclaimers

We work hard on Holofile, but the service is provided “as is” and “as available”. To the extent the law allows, we make no promises that it will be uninterrupted, error-free or fit for a particular purpose, or that prices, matches or other data will be accurate or complete. Keep your own records of anything important; with Holo10, CSV export makes that easy.

Limitation of liability

To the extent the law allows, Holofile isn’t liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the service. Our total liability for any claim about the service is limited to the greater of what you paid for Holo10 in the 12 months before the claim and US$50.

Some places don’t allow these limits, so they may not all apply to you. Nothing in these terms limits rights you have as a consumer that can’t be waived by contract.

Governing law and disputes

These terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules. Any dispute goes to the state or federal courts located in Florida, and you and we agree to their jurisdiction. If you’re a consumer in the EU, the EEA or the UK, you also keep the protection of your own country’s mandatory laws and can bring a claim in your local courts.

Before going to court, please email us at hello@holofile.app: most problems are solved faster that way.

Changes to these terms

We may update these terms as Holofile changes. We’ll post the new version here with a new effective date and, for significant changes, tell you in the app before they take effect. If you keep using the service after that, the new terms apply. If you don’t agree, stop using the service and delete your account.

If any part of these terms can’t be enforced, the rest still applies. These terms, the standard EULA and our privacy policy are the whole agreement between you and us about the service.
